On August 22, 2023, the NRC issued a notice of violation and proposed imposition of civil penalty in the amount of $87,500 to BWXT Nuclear Operations Group, Inc. (licensee) for a Severity Level III problem involving two violations related to the licensee’s failure to adequately establish and maintain items relied on for safety (IROFS) to reduce the likelihood of occurrence of a high consequence event accident sequence. Specifically, the licensee (1) failed to ensure an air gap control was available and reliable to prevent a high consequence accident and (2) failed to ensure an overflow line control was available and reliable to prevent a high consequence accident, contrary to Title 10 of the Code of Federal Regulations (10 CFR) Part 70.61.
